As an experienced Bergen County Divorce Attorney I am often asked about finding unreported income. It is very interesting when a client comes in and says that their spouse or they have unreported income. Attorneys are not the IRS; we are not going to arrest you or report that. However, you have to be very careful in a divorce case when giving that information to a judge or a court because there are very exceptional circumstances where it could get you both in trouble. We would have to talk about the situation and make sure that everyone is protected. In a divorce case, however, we deal with the unreported income as any other income. We add it back as part of all the calculations and the division of assets.
