The Process of Dismissing a Final Restraining Order

Dismissing a final restraining order requires that you go to the courthouse where you will be referred to the domestic violence unit. They will counsel you as to whether or not you truly want to dismiss the order – based on whether or not you feel safe in view of the fact that, at one point, you felt a need to file for a restraining order. Once the domestic violence unit believes you are sincere – and that your reasons for wanting to dismiss are legitimate – they will send you to the judge, who will ask you essentially the same questions to ensure that you’re not being coerced or under duress to dismiss that restraining order.
