MIDDLESEX COUNTY DIVORCE ATTORNEY ANSWERS FAQS

Divorce comes with many questions. Here are answers to some of them.

What is the process for dividing property in divorce?

You can come to agreement with your spouse on who gets what and have that memorialized in your settlement agreement. If you cannot agree, a judge will divide your assets. The judge will consider the equitable distribution factors in N.J.S.A 2A:34-23.1.  to arrive at what they believe is a fair division, although it may not be a 50/50 split.

Will I have to divide assets I had before my marriage?

Only marital property is subject to division. In general terms, marital property refers to assets or debts acquired during marriage. Separate property is, again in general terms, property you had before marriage, property protected by a premarital or postnuptial agreement, or property gifted only to you or inherited by you. Sometimes, property you thought was separate could be considered marital if it is mixed into household finances. A Middlesex County divorce lawyer will help you determine if it is separate or marital property and argue on your behalf if your spouse claims your separate property is marital property.

Will I have to sell my business and split the monies with my spouse?

Not necessarily. We will need to understand your unique situation in this respect. If your business was started during the marriage, the business itself and the value or income derived from it will be considered marital.  Your spouse may be entitled to a percentage of your percentage of that business.  But, in no event, will your spouse “work” in the business alongside of you unless that is something you both agree to and want.  Of course, if there is a partnership agreement, how your business gets handled in a divorce may be governed by the terms of this agreement.  Businesses in divorce is one of the more complex areas so you should speak with an attorney to understand the full breath of what this entails.

I believe my spouse is hiding assets—what can I do?

If you believe your spouse is hiding assets to prevent them from being divided in divorce, do not wait to speak with your attorney. We will investigate to find out the truth. This could involve employing forensic accountants and other financial professionals to discover where assets are hidden.  Individuals who hide assets in divorce can be found in contempt of court, ordered to pay the other party’s legal fees, and even lose the asset they attempted to hide.
