What Is Uncontested Divorce?

An uncontested divorce happens when both spouses can agree on all relevant issues without court intervention. These issues typically include:

  • Division of assets and debts
  • Child custody and visitation (if applicable)
  • Child support (if applicable)
  • Spousal support (if applicable).

In an uncontested divorce, the spouses cooperate to draft a marital settlement agreement that outlines the divorce terms. Once both parties have signed the agreement, it is submitted to the court for approval. Uncontested divorces are generally faster, less expensive, and less emotionally taxing than contested divorces.

What Is Contested Divorce?

A contested divorce happens when spouses cannot agree on one or more issues, leading to disputes that must be resolved through court proceedings. Common issues that may lead to a contested divorce include:

  • Disagreements over child custody and visitation schedules
  • Disputes regarding the division of marital property and debts
  • Disagreements over child support or spousal support amounts.

In a contested divorce, spouses typically hire a lawyer to represent their interests in court. The court will then intervene to decide on unresolved issues, considering relevant factors such as the children’s best interests and the financial circumstances of both parties. Contested divorces often involve more time, expense, and emotional stress than uncontested divorces.

How Are Assets and Property Divided in a Divorce in New Jersey?

In New Jersey, assets in a divorce are divided based on the principle of “equitable distribution,” aiming for fairness rather than strict equality. This approach can be more intricate than the 50-50 split typical in community property states, but it often serves the best interests of both spouses.

Under equitable distribution, various assets are subject to division, including bank and investment accounts, pensions, marital homes, real estate, businesses, and vehicles. Only property acquired during the marriage is considered marital property and thus subject to division.

Courts have considerable discretion in determining how assets should be fairly distributed. Factors they may consider include the duration of the marriage, the health and age of each spouse, the standard of living during the marriage, each party’s economic circumstances and earning potential, sacrifices made for the marriage (such as delaying a career for childcare), and child custody arrangements.

Additional criteria for equitable distribution are outlined in N.J.S.A. 2A:34-23.1. For example, if one spouse has primary custody of minor children, they may receive the marital home, while other assets are awarded to the other spouse to balance the division. If one spouse has a substantial separate net worth or significant earnings unrelated to the marriage, the other spouse may receive a larger portion of marital assets to ensure fairness.

How Long Do Contested Divorces Take in New Jersey?

Many divorces start as contested, with spouses unwilling or unable to agree on an equitable division of assets. Child custody, pensions, the sale or division of homes, and even deciding who keeps the family pet can seem like insurmountable challenges when emotions run high at the beginning of a divorce.

Fortunately, common sense and wise legal counsel often prevail over initial anger and confrontation. It is common for couples to reach a settlement agreement well before their scheduled court date, turning a contested divorce into a mutual resolution that satisfies both parties.
