There are two general types of divorce: contested and uncontested. Your divorce is contested if you cannot agree on all the issues of divorce. How does the court divide assets in a New Jersey divorce?

Equitable distribution is the concept that judges in New Jersey use to divide marital assets between divorcing spouses. They consider the factors in N.J.S.A 2A:34-23.1 to arrive at fair decisions. Factors include such things as how long the couple was married, the health of both spouses, income and earning capacity of each spouse, and more. While property is divided in a way that is equitable, it is not necessarily a 50/50 split.

How are alimony payment amounts calculated?

There is no simple plug-in-the-numbers calculation for determining the amount of alimony payments. The court will apply various criteria as defined in N.J.S.A. 2A:34-23 to your specific situation. Will the court favor my spouse in divorce decisions?
