As an experienced Bergen County Divorce Attorney I am often asked about equitable distribution. Equitable distribution means dividing of the assets. You hear the word equal in equitable; that does not mean that you are necessarily going to obtain 50% of the assets. New Jersey is not an automatic 50/50 state. We divide the assets according to the facts of your case and what is fair, reasonable, and equitable. You could get more than 50%, you could get less than 50%, or you could get 50%. It depends on the facts of your particular matter.
