As an experienced New Jersey Divorce Lawyer, a lot of clients ask me whether or not their spouse working or not working is an important factor in the alimony or child support calculation in a divorce matter. The answer is absolutely. It is very important to know that if your spouse is not working, we have to ask the question of why they’re not working. If they’re working but not up to their capacity, then they’re voluntarily underemployed. If they’re not employed at all we need to ask why. In some cases, we use an employability expert which comes in and tells us what it is that your spouse or yourself could or could not be earning depending on your past history, past work skill set, and looking at the future.
